2. Conclusion of Contract
The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the “Buy” button, you submit a binding offer to purchase the goods contained in the shopping cart.
Confirmation of receipt of your order is sent immediately after submission via an automated E Mail. This confirmation does not yet constitute acceptance of your offer.
A contract is only concluded when we accept your order through a separate E Mail, confirm shipment of the goods, or dispatch the goods to you.
3. Prices and Shipping Costs
All stated prices are final prices in Euro. According to Section 19 of the German VAT Act (small business regulation), no VAT is charged or shown.
Additional shipping costs may apply. These will be displayed during the ordering process before you place your order.
4. Delivery
Delivery is made within Germany and to the countries selectable in the online shop.
Unless otherwise stated in the respective product description, delivery time is 3 to 18 business days after receipt of payment.
Should delivery delays occur in exceptional cases, we will inform you immediately via E Mail.
Partial deliveries are permitted where reasonable for you.
5. Payment
The payment methods displayed during the ordering process are available to you.
Unless otherwise stated for the selected payment method, the purchase price is due immediately upon conclusion of the contract.
6. Retention of Title
The goods remain our property until full payment has been made.
7. Optional Assembly Service
Where expressly selected during the ordering process, we additionally offer an optional assembly service for the delivered rollator.
The assembly service is an independent additional service separate from the delivery of goods. The subject matter of the assembly service is exclusively the professional assembly of the delivered product and a standardized basic adjustment where customary for the product type.
The assembly service does not include medical advice, therapeutic services, healthcare activities, or any individual assessment of whether the product is suitable for the customer’s personal health needs.
Any further medical or therapeutic assessment remains exclusively the responsibility of doctors, therapists, or other appropriately qualified professionals.
The assembly service is carried out by qualified personnel.
A prerequisite for carrying out the assembly service is that the customer provides access to the premises at the agreed appointment time and that safe and standard execution on site is possible.
Where a functional test is carried out as part of the assembly service, this relates exclusively to the general technical basic functionality of the product at the time of handover.
After completion of the assembly service, the customer is obliged to report any recognizable defects or complaints without undue delay.
8. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal in accordance with the separate withdrawal policy.
Where we additionally grant a voluntary return policy, only the separately communicated conditions on our website shall apply.
9. Warranty
The statutory warranty rights apply.
Claims for defects expire two years after delivery of the goods.
10. Liability
We are fully liable for intent and gross negligence.
In cases of simple negligence, we are only liable for damages resulting from injury to life, body, or health, as well as for the breach of an essential contractual obligation. Essential contractual obligations are obligations whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely.
In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract.
The above limitations of liability also apply in favor of our legal representatives, employees, and agents.
If modifications are made to the product by the customer or third parties after completion of the assembly service, we are not liable for damages resulting from such modifications.
Likewise, we are not liable for damages resulting from improper use, use contrary to the intended purpose, or use contrary to the manufacturer’s instructions.
Mandatory statutory liability provisions, particularly under the German Product Liability Act, remain unaffected.
11. Notes on Product Use and Selection
Our product descriptions and the optional assembly service do not replace medical, therapeutic, or other healthcare advice.
If necessary, the decision whether a specific rollator is suitable for your individual health needs should be discussed with an appropriately qualified professional.
For the safe use of the product, the manufacturer’s instructions, operating manual, and product specific safety information are decisive.
12. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Used and Refurbished Rollators
Where used or refurbished rollators are offered in the online shop, these are previously used products acquired from private previous owners.
Before resale, the used or refurbished rollators undergo a visual, functional, and safety inspection by us. Where necessary, cleaning, maintenance work, or replacement of individual wear parts may be carried out. However, a complete technical inspection of all components or an inspection for hidden defects is not performed.
Despite inspection, used or refurbished rollators may show age- and usage-related signs of wear, including cosmetic imperfections, scratches, discoloration, or other visible signs of use. The product description at the time of purchase shall exclusively determine the condition and scope of delivery of the product.
Unless expressly stated otherwise, information in product descriptions, images, advertising statements, and other representations does not constitute a guarantee, warranty, or agreement on specific product characteristics.
We do not assess or guarantee whether a product is suitable for the individual health, physical, or therapeutic needs of the customer. Use of the product is at the customer’s own responsibility and must be in accordance with the manufacturer’s instructions, operating manual, and safety guidelines.
To the extent permitted by law, the limitation period for claims relating to defects in used goods is one year from delivery of the product.
The above limitation does not apply to claims arising from intentional misconduct, gross negligence, or damages resulting from injury to life, body, or health.
Liability for normal wear and tear, age related material changes, improper use, unauthorized modifications to the product, or damages resulting from use contrary to the manufacturer’s instructions is excluded.
14. Final Provisions
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless this deprives the consumer of the protection granted by mandatory provisions of the state in which the consumer has their habitual residence.
